Part 7: The Unspoken Promises
During a short mid-morning recess, Toby sat beside me at the table, unusually silent as he stared at his hands. I put my arm around his shoulders and gently asked what was troubling him.
After a long silence, he whispered that Russell had promised him a huge bedroom set, a brand new mountain bike, and a golden retriever puppy if he agreed to live full-time at the city townhouse.
But that was not the worst part. Russell had also warned Toby sternly that if he said anything negative about his father in court, the puppy would be given away to someone else.
When the judge returned and the hearing resumed, I raised my hand and told the court what my son had just revealed.
Judge Leonard looked down at Toby and spoke gently. “Toby, did your father tell you that getting a new puppy depended on what you said in this courtroom today?”
Toby quietly nodded. “He told me I should remember which house had a big backyard.”
Russell immediately leaned forward. “Your Honor, I was simply trying to get my boy excited about spending more quality time with me!”
Judge Leonard raised his hand, cutting Russell off completely, his voice carrying authority throughout the courtroom. “A child’s love is not a commodity to be purchased with toys, sir, and his innocent fears are certainly not tools for you to use in a custody fight.”
Russell sank back into his chair, unable to meet anyone’s eyes. For two years, he had managed to make every excuse sound reasonable, but inside that courtroom, his polished explanations had finally run out.
Part 8: The Verdict and Beyond
Judge Leonard spent several quiet minutes reviewing the official documents before finally addressing the courtroom. Toby held my hand tightly beneath the table, his warm fingers wrapped around mine.
“This court does not determine parental fitness based on expensive clothing labels, square footage, or polished suits,” Judge Leonard began, looking firmly toward Russell. “While financial resources are certainly relevant, they do not excuse manipulative behavior or emotional neglect.”
The judge then turned toward me. “Mrs. Davenport works extremely hard under difficult circumstances. The evidence clearly shows that her recent financial troubles were directly caused by delayed child support payments.”
